CASTING APPLICATION PRIVACY POLICY *

PRIVACY POLICY 1. Scope Of Privacy Policy This Privacy Policy describes how Blink49 Content Development LLC, and its affiliated and parent companies (together, the “Producer”), and any other financier and/or distributor of the Program (collectively, “Broadcaster”, and together with Producer, “we”, “us” and/or “our”) of the production currently entitled “Untitled Sports Reality Show” (the “Program”) treat Personal Information (as defined herein) we collect, both online and offline, in relation to the casting of the Program. This Privacy Policy explains the type of information we process, why we are processing it and how that processing may affect you. This Privacy Policy applies to all cast members, individuals who apply for a position with or audition to be cast in the Program, including individuals who submit their Personal Information via the online application form (“Program Participants”). By applying for a cast position or otherwise participating in a Program, you acknowledge the data collection practices and purposes outlined in this Privacy Policy. This Privacy Policy is for information purposes only and does not mean or imply that you will be chosen to work on the Program. 2. Personal Information and Personal Data Collection We collect information from and about you in connection with the Program, including information: (i) that you provide us as part of your Application; and (ii) from third parties or public sources (e.g., recruitment/casting agencies or social media profiles). Some of this information may be considered “Personal Information”, as defined under applicable law. Personal Information, which also includes “Personal Data” is information relating to you (or from which you may be identified) which is processed by automatic means or which is (or is intended to be) part of a structured manual filing system. It includes not only facts about you, but also intentions and opinions about you. We may also collect sensitive information from you with your consent. Sensitive personal data may include Personal Information regarding racial or ethnic origin, political opinions, religious or philosophical beliefs, health, sexual orientation, sex life, trade union membership and genetic and biometric data and data regarding the commission or alleged commission of any criminal offense. 3. Personal Information Source Personal Information is provided by you directly. Examples of the types of Personal Information that we may request from you will include, but may not be limited to, the following: • Contact details, such as name, email address, postal address, phone number, and mobile number; • Photos and videos of you submitted by you; • Age and date of birth; • Other demographic information, such as personal characteristics, gender, level of education and occupation information; • Public information, including profile information, such as your user name, comments, likes, interests, status, pictures and the address of your website; • Information posted in community discussions and other interactive online features; • Correspondence you send to us; • Information collected about you offline (including via mail, or in person); • Any content you submit or transmit on the online auditions platform, including audio, video, text, or other materials; Where permitted by applicable law, we may collect information about you from other sources, including casting agencies, social media or background check providers. Information collected from third parties may include publicly-observed data, such as activities on blogs, videos, and other online postings. This Privacy Policy does not cover the practices of third parties, including those that may disclose information to Producer, and their use of your information is governed by the privacy policies of such third parties. 4. Personal Data Storage We do not keep your personal data for any specific period but will not keep it for longer than is necessary for our purposes. If you are chosen to work on the Program, we will keep your personal data for the duration of your engagement and the duration of the exploitation of the Program. Otherwise, we will only retain for your personal data for a short period (maximum 12 months) of time after the casting process. Then, we may delete it. In processing your personal data, we act as a data controller. 5. Use of Personal Information Your Personal Information may be seen internally by relevant people working on the Program. We use your information for the purposes described in this Privacy Policy and as further disclosed to you, as and when necessary. We will use your Personal Information in ways that are consistent with our legitimate interest in casting and production activities, including to: • Facilitate auditions, processing being necessary for the purposes of your or our obligations and rights in relation to your engagement in so far as it is authorized by law or collective agreement; • Contact you about your application, the casting process, and/or your involvement in the Program as well as to respond to any of your requests; • Processing relating to data about you that you have made public (e.g. if you tell us you are ill); • Processing being necessary for provision of health care or treatment, medical diagnosis, and assessment of your working capacity (including (but not limited to) for infectious disease control and/or health emergencies such as a pandemic/epidemic); • Verify all information you provide to us for purposes of compliance rules for the Program; • Processing for equality and diversity purposes to the extent permitted by law; • Comply with legal investigations and inquiries; • Processing being necessary for the purpose of establishing, making or defending legal claims; and • For any other purposes disclosed to you at the time we collect your information, pursuant to your consent or as otherwise authorized by law. 6. Personal Data Disclosure We may share Personal Information with our affiliates that are involved in casting decisions and otherwise connected to the Program. We also share your Personal Information with third parties in a limited number of circumstances as follows: • When you sign a contract with us in relation to the Program, we will disclose your Personal Information in accordance with the terms of that contract, including when Program content is aired or distributed publicly. • With your consent, we may share your contact information with third party marketing partners services. • We may disclose sensitive Personal Information contained within or derived from Program to third parties connected with the Program and to compile information from third parties in connection with the application process about Program Participant’s sensitive Personal Information. We may reveal such sensitive Personal Information to third parties in the course of the Program application or audition process. • We may also engage a third party to provide some of the services associated with the auditions. This third party will collect and host the information that you submit to us but will not use any of this information for purposes other than providing the services in relation to auditions. Personal Information submitted will not be made publicly available and will only be visible to us, our business partners and our representatives associated with the audition. • We may disclose information about Program Participants, including contact information, to respond to subpoenas, court orders, legal process, and other law enforcement measures, and to comply with other legal obligations. 7. Access to Personal Data You have a right to make a subject access request to receive information about the data that we process about you. We try to be as open as we reasonably can about personal data that we process. If you would like specific information, just ask us. You also have a legal right to make a “subject access request”. If you exercise this right and we hold personal data about you, we are required to provide you with information on it, including by giving you a description and copy of the personal data and telling you why we are processing it. If you make a subject access request and there is any question about who you are, we may require you to provide information from which we can satisfy ourselves as to your identity. As well as your subject access right, you may have a legal right to have your personal data rectified or erased, to object to its processing or to have its processing restricted. 8. Personal Data Security We are committed to protecting your information. We have adopted commercially reasonable technical, administrative, and physical security procedures to help protect your information from loss, misuse, unauthorized access, and alteration. Please note that no data transmission or storage can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you transmit to us. 9. Complaints If you have complaints relating to our processing of your personal data, you should raise these with your key contact at the production in the first instance. Privacy Policy Status This Privacy Policy is for information purposes only and does not mean or imply that you will be chosen to work on one of our productions. From time to time, we may change this Privacy Policy to accommodate new technologies, industry practices, regulatory requirements, or for other purposes. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent. Notice may be by email to you at the last email address you provided us, by posting notice of such changes on our websites, or by other means, consistent with applicable law.

TERMS AND CONDITIONS For other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I am making the following representations, warranties, indemnities, covenants, agreements and releases in this applicant release and agreement (“Agreement”) in consideration for the production company or their assigns and designees (collectively, “Producer”) to consider me as a participant for an audio-visual production currently entitled “Untitled Sports Reality Show” (the “Program”) intended for initial exhibition on one or more television networks or streaming platforms authorized to exhibit the Program (collectively, “Network”). I certify that there are no reasons which would prevent me from participating in the Program. I grant Producer the right to interview me in connection with my casting application to participate in the Program and to tape and photograph me and record my name, voice, likeness, and conversations, including quotes, paraphrases and sounds (collectively, the “Recordings”) for use in any such interview and in and in connection with the Program, and in advertising, merchandising, promotion and publicity for the Program, as well as in connection with any other production and the advertising, merchandising, promotion and publicity therefore, and for any entity that exhibits in any manner the Program or any other production, in any manner and all media now known or hereafter devised, throughout the universe in perpetuity, in any and all versions now known or hereafter devised, in or in connection with the Program. I further acknowledge that I may be required to provide or may elect to provide Producer with photographs and/or videotapes of me and/or other materials (the “Submission Materials”) as part of my Agreement to be a participant in the Program. I also understand and agree that this Program is a non-guild production and there will be no residual or any other type of payment due in connection with my participation. I further agree that the information contained on this application, the Recordings, and/or the Submission Materials (collectively, “Material”) shall be deemed to be “works-made-for-hire” under the Copyright Act, and if any of the Material or any part thereof is for any reason deemed not to be a “work-made-for-hire” then I hereby irrevocably and perpetually grant and assign to Producers all rights of any nature in and to the Material. I agree that Producer shall be the exclusive owner of all copyright and other rights in and to the Program, the Material and will be able to use them forever and throughout the world, and to assign them, and to license others to use them, in any manner Producer may wish and in any manner and all media now known or hereafter discovered or developed. Without limiting the foregoing, the Material may be edited, cut, rearranged or otherwise revised or modified, and I expressly waive any and all “moral rights” I may have with respect to the Material or Program. I agree that Producer may use and license or assign others (including Network) the right to use the Materials, and my name, voice, actions, likeness, appearance and any biographical facts (my “Appearance”) which may have been provided to Producer, in and in connection with the Program (including, but not limited to, commercial tie-ins and merchandising of the Program), in any related or derivative versions and/or uses of the Program (including, without limitation, any serialization(s), translation(s) and/or adaptation(s) thereof), in any other production, and/or in the advertising, marketing, publicity and promotion of the Program, any other production and/for the Network, any sponsor of the Program (“Sponsor”) and/or Producer in all media (and/or any such party’s or production’s related products), whether or not I am selected to participate in the Program. I confirm that any statements made by me in the casting application, Agreement, the Recordings and Submission Materials will be true and accurate and will not violate or infringe upon any third party's rights. I agree that I will sign whatever other documents Producer, Network and/or Sponsor requires that are necessary to enforce the rights that I am granting to Producer hereunder. I irrevocably and absolutely grant the rights hereunder whether or not I am selected to participate in the Program. I represent and warrant that (i) I have the right to grant the rights granted hereunder; (ii) I have the right to enter into this Agreement; and (iii) the consent of no other person, firm, corporation or labor organization is required for the grant of rights hereunder or to enable Producer to exploit the my Appearance and/or the Material as described herein. I acknowledge that Producer may determine, in its absolute discretion, whether or not to select me to participate in the Program and that Producer has the right to remove me from further consideration as a potential participant at any time for any reason. Producer has no obligation to interview me in connection with my casting application, to select me as a participant in the Program, to produce the Program or have me appear, if selected. Further, even if I am selected as a contestant and appear in the Program, neither Producer nor Network have any obligation to broadcast or otherwise exploit, the Program, the Material, my appearance therein, or any portion thereof. Producer has no obligation to return any Submission Materials, whether or not I am selected as a participant in the Program. I acknowledge and agree that all decisions by Producer concerning the selection of participants is at Producer’s sole discretion and not subject to challenge or appeal. I agree to defend and indemnify the Releasees (defined below) and hold them harmless from any and all liabilities, claims, actions, damages, expenses and losses (including, without limitation, attorneys’ fees) of any kind or nature whatsoever in any way caused by or arising out of my participation in casting process for the Program, a breach or alleged breach of any of my agreements, representations or warranties made in connection with the Program, or the exploitation of any of the rights I have granted in connection with the Program. I acknowledge and agree that any information disclosed to me or obtained by me in connection with the Program or otherwise disclosed to me by Producer, including without limitation, the Program’s subject matter, content and outcomes (including the names of participants, hosts, etc.), shall be strictly confidential and I hereby agree to not disclose to anyone any information or materials of any kind relating to the Program (collectively, the “Confidential Information”), unless and until Producer, Sponsor or Network discloses such Confidential Information (if ever). Disclosure by me in violation of this Agreement shall constitute a material breach of this Agreement and I agree that Producer shall have the right to utilize all available remedies under the law. I recognize that if I breach this paragraph, I would cause the Producer irreparable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and, therefore, I hereby expressly agree that Producer shall be entitled to injunctive and other equitable relief (without posting bond) to prevent and/or cure any breach or threatened breach of this paragraph. I also recognize that proof of damages suffered by Producer in the event that I breach this paragraph will be costly, difficult, or inconvenient. Accordingly, I agree to pay Producer the sum of Ten Thousand Dollars ($10,000.00) per breach. Additionally, I understand that any invitation to participate in the Program may or will be conditioned on my submitting to background checks and physical, medical and/or psychological examinations to be conducted by medical professionals selected by and paid for by Producer and the certification of such medical professionals that I meet all physical and psychological requirements in order to participate in the Program. I represent and warrant that I am in good health and have no medical, physical, or emotional condition that might interfere with my participation in the Program and I will not be under the influence of any medication or drugs that might impair my physical or mental ability to participate. RELEASE AND AGREEMENT NOT TO SUE. To the maximum extent permitted by law, I hereby irrevocably and unconditionally release, waive and forever discharge Producer, Sponsor, Network, or any other licensees, assignees or exhibitors of the Program or the Material, all other persons and entities connected with the Program, all parent, subsidiary, related and affiliated entities, licensees, successors, assigns, sponsors, advertisers, related companies, subsidiaries (whether or not wholly-owned), affiliates and divisions of each of the foregoing, each of their past, present and future officers, agents, representatives, employees, successors and assigns, and the respective heirs, next of kin, spouses, guardians, representatives, executors, administrators, successors, licensees and assigns of each of the foregoing, jointly and individually (hereinafter collectively referred to as “Releasees”), from any and all manner of liabilities, claims and demands of any kind or nature, whatsoever, in law or equity, whether known or unknown, which I (or my assigns, agents and/or representatives) ever had, now has, or in the future may have against the Releasees, including, but not limited to, claims arising out of or related to the uses described herein or my casting application for and participation in the Program, and/or the exercise of any rights granted by me herein (collectively, the “Released Claims”). Without limiting the foregoing and to the maximum extent permitted by law, I agree not to sue the Releasees as a result of the Material, use of my casting application or the Material (including, without limitation, any claim that such use defames me, portrays me in a false light or invades any right of privacy and/or publicity or any claim based on any theory of negligence, personal injury, property damage, or intentional or negligent infliction of emotional distress, breach of the duty of care owed under applicable laws, and/or infringement of trademark, patent or copyright) or for any other reason based on any of the Released Claims hereunder. I further agree in the event I bring a claim or lawsuit in violation of this Agreement, I shall be liable for any attorneys’ fees and costs incurred by the Producer, Sponsor, Network and/or any Releasee in connection with such claim or lawsuit. I expressly understand and agree that my rights and remedies against Producer and/or any Releasee shall be limited to the right, if any, to recover money damages in an action at law, and that I shall not be entitled to terminate or rescind this or any other agreement between me and Producer or any of the rights or privileges I have granted or agreed to grant to Producer hereunder, or to enjoin or restrain or otherwise interfere with the development, production, telecast, exhibition, distribution, advertising or other exploitation of the Program, or any part thereof, or any rights therein or herein. I acknowledge that there is a possibility that after my execution of this Agreement, I may discover facts or incur or suffer claims which were unknown or unsuspected at the time this Agreement was executed and which, if known by me at that time, may have materially affected my decision to execute this Agreement. I acknowledge and agree that by reason of this Agreement, including the release of liability contained in the preceding paragraph, I am assuming any risk of such unknown facts and such unknown and unsuspected claims. I have been advised of the existence of Section 1542 of the California Civil Code which provides: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” Notwithstanding Section 1542 of the California Civil Code, this Agreement shall constitute a full release of liability in accordance with its terms. I knowingly and voluntarily waive the provisions of Section 1542, as well as any other statute, law or rule of similar effect, and acknowledge and agree that this waiver is an essential and material term of this Agreement and that without such waiver, Producer would not have accepted this Agreement. MEDIATION & ARBITRATION. The parties agree that if any controversy or claim arising out of or relating to this Agreement cannot be settled through direct discussions, they shall endeavor first to settle the controversy or claim by a mediation administered by JAMS under its applicable rules. IF THE DISPUTE IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, THE PARTIES AGREE THAT THE CONTROVERSY OR CLAIM, INCLUDING THE SCOPE OR APPLICABILITY OF THIS AGREEMENT TO ARBITRATE, SHALL THEN BE RESOLVED BY FINAL AND BINDING CONFIDENTIAL ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF, INCLUDING ITS OPTIONAL APPEAL PROCEDURE (THE “JAMS RULES”, AVAILABLE AT WWW.JAMSADR.COM, INCLUDING, WITHOUT LIMITATION, THE RULE PROVIDING THAT EACH PARTY SHALL PAY PRO RATA ITS SHARE OF JAMS FEES AND EXPENSES, AND THE RULES PROVIDING FOR LIMITED DISCOVERY AND OTHER EXCHANGE OF INFORMATION). THE JAMS RULES ARE AVAILABLE AT WWW.JAMSADR.COM, AND WILL BE PROVIDED BY PRODUCER UPON REQUEST. THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED IN THE ENTERTAINMENT INDUSTRY AND LICENSED TO PRACTICE LAW IN CALIFORNIA OR BE A RETIRED JUDGE. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF LOS ANGELES, CALIFORNIA. THE PARTIES AGREE THAT THE REMEDY FOR ANY CLAIM BROUGHT PURSUANT TO THIS AGREEMENT SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE OR EXEMPLARY DAMAGES OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. NOTWITHSTANDING THE FOREGOING, I RECOGNIZE THAT GIVEN THE UNIQUE NATURE OF THE PROGRAM AND THE COMMERCIAL REALITIES OF THE ENTERTAINMENT INDUSTRY, WHICH RELY UPON CONFIDENTIALITY AND INTELLECTUAL PROPERTY RIGHTS, ANY ACTUAL OR ANTICIPATED BREACH OF MY CONFIDENTIALITY OBLIGATIONS PURSUANT TO THIS AGREEMENT, OR ANY INFRINGEMENT BY ME OF PRODUCER’S, NETWORK’S AND/OR SPONSOR’S INTELLECTUAL PROPERTY RIGHTS, WOULD CAUSE PRODUCER, NETWORK AND/OR SPONSOR (AS APPLICABLE) IRREPARABLE INJURY AND DAMAGE THAT CANNOT BE REASONABLY OR ADEQUATELY COMPENSATED BY MONEY AND, THEREFORE, I AGREE THAT PRODUCER, NETWORK AND/OR SPONSOR (AS APPLICABLE) SHALL BE ENTITLED TO SEEK AND OBTAIN INJUNCTIVE AND OTHER EQUITABLE RELIEF FROM A COURT OF COMPETENT JURISDICTION FOR ANY SUCH BREACH OR INFRINGEMENT. FURTHER AND NOTWITHSTANDING THE FOREGOING, TO THE EXTENT REQUIRED BY LAW, THE PARTIES AGREE THAT WITH RESPECT TO THE ARBITRATION OF ANY FEDERAL OR STATE CLAIM I BRING THAT ARISES FROM UNWAIVABLE PUBLIC RIGHTS, WHETHER STATUTORY OR NON STATUTORY, THE FOLLOWING SHALL APPLY: THE ARBITRATOR MAY AWARD ANY REMEDY THAT WOULD HAVE BEEN AVAILABLE IN COURT; THE PARTIES SHALL BE PERMITTED DISCOVERY ADEQUATE TO SECURE THE NECESSARY INFORMATION TO PRESENT SUCH CLAIM OR DEFEND AGAINST SUCH CLAIM; AND PRODUCER SHALL PAY ALL TYPES OF COSTS THAT ARE UNIQUE TO ARBITRATION. I UNDERSTAND AND AGREE THAT, BY SIGNING THIS AGREEMENT, THE PARTIES ARE AGREEING TO RESOLVE ANY AND ALL CONTROVERSIES OR CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE BREACH OF ANY TERM HEREOF, OR MY PARTICIPATION IN OR IN CONNECTION WITH THE PROGRAM ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS TO THE EXTENT PERMITTED BY APPLICABLE LAW. ACCORDINGLY, UNLESS PROHIBITED BY APPLICABLE LAW, THE PARTIES AGREE TO WAIVE THEIR RESPECTIVE RIGHTS TO BRING, MAINTAIN, AND PARTICIPATE IN ANY CLASS, COLLECTIVE, AND/OR REPRESENTATIVE OR COLLECTIVE ACTION OR PROCEEDING. INDIVIDUAL CLAIMS UNDER THE PRIVATE ATTORNEYS GENERAL ACT BASED ON ALLEGED INDIVIDUAL LABOR CODE VIOLATIONS SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND UNLESS PROHIBITED BY APPLICABLE LAW, THERE WILL BE NO RIGHT OR AUTHORITY TO PURSUE NON-INDIVIDUAL CLAIMS AS A PRIVATE ATTORNEY REPRESENTATIVE INVOLVING LABOR CODE VIOLATIONS AFFECTING OTHER INDIVIDUALS. FURTHERMORE, LESS THE PARTIES AGREE IN WRITING OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION OR PROCEEDING. I FURTHER AGREE THAT, IN THE EVENT THIS WAIVER OF CLASS ACTION/MULTI-PARTY LITIGATION RIGHTS IS FOUND TO BE UNENFORCEABLE, IT SHALL BE SEVERED AND THE REMAINDER OF THIS PARAGRAPH SHALL REMAIN IN FULL FORCE AND EFFECT. TO THE EXTENT PERMITTED BY LAW, THE PREVAILING PARTY WILL NOT BE ENTITLED TO ANY AWARD OF ATTORNEY’S FEES OR COSTS FROM THE OTHER PARTY. THIS PARAGRAPH WILL SURVIVE ANY EXPIRATION OR TERMINATION OF THIS AGREEMENT. The illegality, invalidity or unenforceability of any provision of this Agreement shall in no way affect the validity or enforceability of any of the remainder of this Agreement, which shall be enforced to the maximum extent permitted by law. This Agreement shall be interpreted under the internal, substantive laws of the State of California, without regard to the conflicts of law provisions thereof. To the extent that the arbitration provisions of this Agreement are not enforced, or court proceedings are otherwise required, commenced or maintained, the parties submit to the in personam jurisdiction of the Los Angeles county superior courts and the united states district court for the central district of California, and waive any objections that they may have as to jurisdiction or venue in any such courts. I have read, understand, and agree to be bound by all of the terms and conditions of this Agreement. This Agreement cannot be terminated, rescinded or amended except by an agreement signed by both me and Producer. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS UNDER THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, MY RIGHT TO FILE A LAWSUIT IN COURT WITH RESPECT TO ANY CLAIM ARISING IN CONNECTION WITH THIS AGREEMENT.
